CAREFULLY BEFORE USING THE SERVICES OFFERED BY AI-Ink. THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE AILINK WEBSITE AND ALL RELATED SERVICES, INCLUDING, WITHOUT LIMITATION, ANY FEATURES, CONTENT, WEBSITES (INCLUDING WWW.AI-Ink) OR APPLICATIONS OFFERED FROM TIME TO TIME BY AI-Ink IN CONNECTION THEREWITH (COLLECTIVELY "SERVICE(S)"). BY USING THE SERVICES IN ANY MANNER, YOU AGREE TO BE BOUND BY THIS AGREEMENT.
The Service is offered subject to acceptance without modification of all of these Terms of Service and all other operating rules, policies and procedures that may be published from time to time in connection with the Services by AI-Ink. In addition, some services offered through the Service may be subject to additional terms and conditions promulgated by AI-Ink from time to time; your use of such services is subject to those additional terms and conditions, which are incorporated into these Terms of Service by this reference. AI-Ink may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Service is revoked in such jurisdictions.
Modification of Terms of Service: At its sole discretion, AI-Ink may modify or replace any of the Terms of Service, or change, suspend, or discontinue the Service at any time by posting a notice or by sending you an email. It is your responsibility to check the Terms of Service periodically for changes. Continued use constitutes acceptance.
As a condition of use, you promise not to use the Service for any purpose that is prohibited by the Terms of Service. "Content" includes, without limitation, any information, data, text, photographs, videos, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible on or through the Service.
All AI-Ink logos, marks and designations are trademarks or registered trademarks of AI-Ink. All other trademarks mentioned are the property of their respective owners. Portions, features and/or functionality of AI-Ink's products may be protected under AI-Ink patent applications or patents.
AI-Ink grants you a limited, non-exclusive, non-transferable license to use the designs generated by our AI for personal use. Personal use means using the designs to get tattooed on your own body or for the purpose of designing a tattoo for a friend or family member.
If you intend to use the designs generated by AI-Ink for commercial purposes, you must purchase a subscription or pay for credits to use our service. Failure to do so constitutes a breach of these Terms of Use.
You are not permitted to resell or redistribute the designs generated by AI-Ink, whether for profit or not. All rights to the designs belong to AI-Ink and any unauthorized use will be considered a breach.
AI-Ink retains all rights, title, and interest in and to the designs generated by our AI. You acknowledge that the designs are the property of AI-Ink and that you have no right to use the designs other than as expressly set forth in these Terms of Use.
We may use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display any AI-Ink Images worldwide and/or incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such AI-Ink Images. We may use your name likeness in connection with any AI-Ink Images.
AI-Ink may terminate your access to all or any part of the Service at any time if you fail to comply with these Terms of Service. Either party may terminate the Services for any reason and at any time upon written notice. Any fees paid are non-refundable. Upon termination, all rights and licenses granted to you shall immediately terminate, but all provisions which by their nature should survive termination shall survive.
You shall defend, indemnify, and hold harmless AI-Ink, its affiliates, employees, contractors, directors, suppliers and representatives from all liabilities, losses, claims, and expenses, including reasonable attorneys' fees, that arise from or relate to your use or misuse of, or access to, the Service, or your violation of the Terms of Service or any applicable law, contract, policy, regulation or other obligation.
IN NO EVENT SHALL AI-Ink OR ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO THE SERVICE for any lost profits, data loss, cost of procurement of substitute goods or services, or special, indirect, incidental, punitive, or consequential damages of any kind whatsoever, or substitute goods or services, for your reliance on the Service or for any direct damages in excess (in the aggregate) of the fees paid by you for the Service or, if greater, $500.
ALL USE OF THE SERVICE AND ANY CONTENT IS UNDERTAKEN ENTIRELY AT YOUR OWN RISK. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" AND IS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
The Terms of Service are the entire agreement between you and AI-Ink with respect to the Service, and supersede all prior or contemporaneous communications. If any provision is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary. The failure of either party to exercise any right shall not be deemed a waiver. AI-Ink shall not be liable for any failure to perform its obligations due to any cause beyond its reasonable control. The Terms of Service are personal to you, and are not assignable or transferable by you except with AI-Ink's prior written consent. AI-Ink may assign, transfer or delegate any of its rights and obligations without consent. No agency, partnership, joint venture, or employment relationship is created as a result of the Terms of Service. All notices will be in writing and deemed given when received or two days after sent for next day delivery by recognized overnight delivery service.
These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction in which AI-Ink is located, without giving effect to any choice of law or conflict of law provision or rule.
